NEPA is a bedrock law, known as \"the people's law,\" that provides a way for communities to have a say in the federal projects that impact their neighborhoods, health, and lives."},"page_layout":[{"acf_fc_layout":"layout_hero_links","acfe_flexible_toggle":"","component_hero_links":{"title":"","abstract":"","links":null}},{"acf_fc_layout":"layout_wysiwyg","acfe_flexible_toggle":"","component_wysiwyg":{"content":"<strong>What is NEPA, and Why Should You Care?<\/strong>\r\nSigned into law in 1970, the National Environmental Policy Act (NEPA) requires federal agencies to study and analyze the environmental effects of proposed plans prior to making decisions on whether or not to proceed with them. Before NEPA, federal agencies did not have to even consider the environmental impacts of their actions. After NEPA, these agencies, in cooperation with state and local governments, must use all practical resources to create conditions in which \"man and nature can exist in productive harmony.\"\r\n\r\n[caption id=\"attachment_5641\" align=\"alignright\" width=\"300\"]<img class=\"size-medium wp-image-5641\" src=\"https:\/\/weact.org\/wp-content\/uploads\/2025\/04\/toxic-tour-1-scaled-1-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" \/> Power plant across from a playground in Port Arthur, Texas. Photo by AJ Yuan, WE ACT for Environmental Justice[\/caption]\r\n\r\nSpecifically, NEPA requires all federal agencies to prepare detailed Environmental Assessments and Environmental Impact Statements for projects and actions they undertake. The purpose of the law is two-fold, ensuring that the government does due diligence in determining the full extent of any potential impacts a proposed project may have on the environment and surrounding communities as well as ensuring that those communities are aware of any such potential impacts and have a voice in whether and how they are implemented.\r\n\r\nBy publishing these studies, as is required by NEPA, the public can not only gain a better understanding of the environmental impacts of a given project, but they can also respond accordingly. There are major changes being proposed. See WE ACT's <a href=\"https:\/\/weact.org\/wp-content\/uploads\/2025\/08\/EJ-Comments-for-DOE-Interim-Final-Rule.pdf\">letter<\/a> with CJA and GreenLatinos:\r\n<ol>\r\n \t<li><span style=\"font-weight: 400;\">Removing consideration of environmental justice and cumulative impacts in NEPA analyses.<\/span><\/li>\r\n \t<li><span style=\"font-weight: 400;\">Getting rid of clear public engagement guidelines.<\/span><\/li>\r\n \t<li><span style=\"font-weight: 400;\">Ending Council on Environmental Quality (CEQ)\u2019s long-standing regulations.<\/span><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\r\n<\/span><\/span><\/li>\r\n \t<li><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Directing individual agencies to have separate NEPA processes.\r\n<\/span><\/span><b><\/b><\/li>\r\n<\/ol>\r\n<span style=\"font-weight: 400;\"><b>Weakening NEPA has big negative impacts.<\/b> These moves threaten to weaken protections for environmental justice communities, make involvement in decision-making more difficult, and reduce public participation, transparency, and equity.<\/span>\r\n\r\n[caption id=\"attachment_5640\" align=\"alignleft\" width=\"336\"]<img class=\" wp-image-5640\" src=\"https:\/\/weact.org\/wp-content\/uploads\/2025\/04\/sowing-justice-300x300.jpg\" alt=\"\" width=\"336\" height=\"336\" \/> Marquita Bradshaw, Sowing Justice, Memphis, TN[\/caption]\r\n\r\n<b>Individual agency NEPAs create chaos and further injustice. <\/b><span style=\"font-weight: 400;\">Encouraging individual NEPA processes for each agency is creating chaos, and multiple agencies including the Department of Energy, Department of the Interior, and Department of Agriculture now \u201c<\/span><a href=\"https:\/\/www.catf.us\/2025\/08\/rolling-back-nepa-puts-clean-energy-progress-and-public-trust-at-risk\/\"><span style=\"font-weight: 400;\">all limit public engagement, weaken environmental reviews, and ultimately increase risks of project uncertainty, community opposition, and delay.\u201d<\/span><\/a>\r\n\r\n<b>Context matters: Deregulation in a pro-fossil fuel administration is dangerous. <\/b><span style=\"font-weight: 400;\">Even if Congress passes bipartisan permitting reform legislation, the current administration's priorities do not guarantee that transmission and clean energy projects will even receive federal permits, and will instead continue a no-guardrails approach to deadly fossil fuel buildout.\u00a0<\/span>\r\n\r\n<strong>Deregulation in the guise of \"permitting reform\" is not the answer. <\/strong>Explore our new storymap to learn more about holistic solutions to clean energy transition advancements including:\r\n<b><\/b>\r\n<ul>\r\n \t<li aria-level=\"1\"><b>Strengthen NEPA &amp; early and meaningful community engagement.<\/b><span style=\"font-weight: 400;\"> The <\/span><a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/senate-bill\/919\"><span style=\"font-weight: 400;\">A. Donald McEachin Environmental Justice for All Act <\/span><\/a><span style=\"font-weight: 400;\">includes legislative language that would strengthen community engagement requirements for development projects and cumulative impacts. This bill is championed by communities not just because of its provisions, but because the late representatives A. Donald McEachin and Raul M. Grijalva <\/span><a href=\"https:\/\/democrats-naturalresources.house.gov\/environmental-justice\"><span style=\"font-weight: 400;\">took the bill across the country<\/span><\/a><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> to ensure it was written by communities, for communities.<\/span><\/span><\/li>\r\n \t<li aria-level=\"1\"><b>Adequate funding and staffing within agencies responsible for NEPA implementation. <\/b><span style=\"font-weight: 400;\">Environmental justice advocates celebrated <\/span><a href=\"https:\/\/weact.org\/updates\/we-act-and-greenlatinos-respond-to-nepa-phase-ii-updates-announcement\/\"><span style=\"font-weight: 400;\">the $1 billion for NEPA implementation which was included in the <\/span><\/a><span style=\"font-weight: 400;\">IRA, and research from the Biden-Harris administration showed that this investment directly led to the <\/span><a href=\"https:\/\/bidenwhitehouse.archives.gov\/briefing-room\/statements-releases\/2024\/08\/29\/fact-sheet-biden-harris-administration-takes-action-to-deliver-more-projects-more-quickly-accelerates-federal-permitting\/\"><span style=\"font-weight: 400;\">decrease of permitting timelines by 6 months<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\">\r\n<\/span><\/li>\r\n<\/ul>\r\n<ul>\r\n \t<li aria-level=\"1\"><b>Greater interagency coordination. <\/b><span style=\"font-weight: 400;\">The Biden-Harris administration successfully utilized <\/span><a href=\"https:\/\/bidenwhitehouse.archives.gov\/briefing-room\/statements-releases\/2022\/05\/11\/fact-sheet-biden-harris-administration-releases-permitting-action-plan-to-accelerate-and-deliver-infrastructure-projects-on-time-on-task-and-on-budget\/\"><span style=\"font-weight: 400;\">improved interagency coordination<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/bidenwhitehouse.archives.gov\/ceq\/news-updates\/2024\/07\/17\/ceq-releases-recommendations-on-digital-tools-to-modernize-environmental-reviews-increase-transparency-and-accessibility-of-federal-permitting\/\"><span style=\"font-weight: 400;\">developed digital and online tools to better communicate with developers and stakeholders<\/span><\/a><span style=\"font-weight: 400;\">, and increased transparency and accessibility of project requirements overall.\r\n<\/span><span style=\"font-weight: 400;\">\r\n<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Address transmission acceleration and clean energy separately. <\/b><span style=\"font-weight: 400;\">In 2022, groups including WE ACT for Environmental Justice drafted the <\/span><a href=\"https:\/\/weact.org\/wp-content\/uploads\/2022\/12\/Transmission-Principles-Letter-121522.pdf\"><span style=\"font-weight: 400;\">Transmission Principles<\/span><\/a><span style=\"font-weight: 400;\">, as well as a corresponding <\/span><a href=\"https:\/\/weact.org\/wp-content\/uploads\/2023\/06\/06222023_transmission_whitepaper_final.pdf\"><span style=\"font-weight: 400;\">white paper<\/span><\/a><span style=\"font-weight: 400;\">, outlining solutions that would address the backlog of clean energy generators waiting to be connected to the grid.\u00a0<\/span><\/li>\r\n<\/ul>\r\n<strong>The Environmental Justice Implications of NEPA Webinar<\/strong>\r\nhttps:\/\/www.youtube.com\/watch?v=LTRG9kvLKmE\r\n\r\n<strong>Additional Resources<\/strong>\r\n<a href=\"https:\/\/ceq.doe.gov\/get-involved\/citizens_guide_to_nepa.html\" target=\"_blank\" rel=\"noopener noreferrer\">Citizen's Guide to NEPA<\/a> (in both English &amp; Spanish)\r\n\r\n<a href=\"https:\/\/www.epa.gov\/environmentaljustice\/environmental-justice-and-national-environmental-policy-act\" target=\"_blank\" rel=\"noopener noreferrer\">Environmental Justice Considerations in the NEPA Process<\/a>\r\n\r\n<a href=\"https:\/\/www.weact.org\/wp-content\/uploads\/2018\/07\/NEPA-Alert-1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">WE ACT's NEPA Alert #1: What is NEPA<\/a>\r\n\r\n<a href=\"https:\/\/www.weact.org\/wp-content\/uploads\/2018\/07\/NEPA-Alert-2.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">WE ACT's NEPA Alert #2: What is Changing<\/a>","include_drop_cap":false}}]},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v24.1 -
